Policy interpertation: 《Announcement on Random Inspection of Imported Commodities Except Statutory I

- In accordance with the relevant provisions of the Import and Export Commodity Inspection Law of the People's Republic of China and its implementation regulations, the General Administration of Customs has decided to conduct random inspections on some import and export commodities other than the statutory inspection commodities from the date of this announcement.

 

Random inspections are carried out in accordance with the "Administrative Measures for Import and Export Commodities Sampling Inspections" (previously issued by Order No. 39 of the General Administration of Quality Supervision, Inspection and Quarantine, revised by Order No. 238 of the General Administration of Customs)

 

The scope of commodities subject to random inspection of import and export commodities other than statutory inspection commodities in 2020

  1. Imported goods: children's clothing, stationery, neckties, scarves, scarves, toilets, dishwashers, air purifiers, printers, electric water heaters, microcomputers, televisions, monitors, junk food processors, induction cookers, machines Motor car horns, motor vehicle retro reflectors, motor vehicle brake hoses, car interior parts, dyes, pigments, coloring materials, etc.
  2. Export commodities: simulation accessories, children's bicycles, children's scooters, electric strollers, plush toys, electric faucets, etc.

 

How does the customs implement random inspections?

 

  1. Formulation Plan

The General Administration of Customs formulates and issues a random inspection plan for non-catalog imported commodities every year.  Including commodity name, inspection basis, sampling requirements, test items, judgment basis, implementation time, etc., and may adjust the random inspection plan when necessary, or issue special import and export commodity spot check inspection plan.

 

  1. Develop a random inspection plan and implement sampling

In the random inspection plan of the supervising customs, after necessary investigation and combined with the actual situation of relevant import and export commodities in the region, will determine the enterprise to be randomly inspected and formulate a specific implementation plan.

 

Specific implementation of sampling:

 

1) Port deployment control

The General Administration of Customs, based on the distribution of import business at various ports across the country, combined with the sensitivity of commodities, issues control instructions at ports. Most of this method is based on imported goods.

 

2) Sampling inspection in the field of market circulation

The customs "randomly" inspect some imported commodities for inspection in "planned" market circulation areas such as shopping malls and physical stores.

"Planned" refers to a plan for on-spot checking the types and quantities of commodities in advance.

"Random" refers to random inspection locations and specific commodities.

The above method only refers to the random inspection of imported goods.

 

3) Enterprise verification

According to the types of commodities, the customs will select the corresponding on-spot checked commodities according to the business volume of export enterprises in the jurisdiction. Some commodities will be checked on-spot by means of verification. This method mostly refers to the on-spot checking of export commodities.

 

 

  1. Sample testing and subsequent disposal

After the customs takes samples, the samples are sent to qualified laboratories for testing. Conformity assessment is performed according to the mandatory requirements of the national technical specifications or other relevant technical requirements designated by the General Administration of Customs. For those who fail to pass the inspection, the customs will implement measures such as technical rectification, prohibition of export, return, destruction, and notification of market supervision and other relevant departments in accordance with the law.

 

Enterprise precautions concerning the random inspection

 

  1. The selected enterprise needs to cooperate with the on-spot inspection and shall not obstruct it. It shall provide necessary working conditions.
  2. The customs conducts random inspections of import and export commodities and collects inspection fees from the enterprises subject to random inspections.
  3. The enterprises subject to random inspection shall collect the remaining samples within the specified time; if the samples are not collected within the time limit, the customs shall process them.
  4. Enterprises that refuse to conduct random inspections without justified reasons shall have their products deemed unqualified. They will be publicly exposed when they refuse to accept random inspections in accordance with relevant regulations.
